Acting Prosecutor General submitted requests to lift the immunity of four members of Parliament from the 51st National Assembly and one candidate for mayor of a district in Sofia Municipality

Acting Prosecutor General Borislav Sarafov submitted to the 51st National Assembly motivated requests for permission to bring to criminal liability four members of Parliament - N. Dimitrov, S. Krumov, Y. Todorov and I. Chorbov, as well as a request to the Central Election Commission (CEC) to lift the immunity of P. Ananiev, a candidate for mayor of a district in Sofia Municipality. 

The requests are based on proposals from the Sofia City Prosecutor's Office (SCPO). During the investigation, inspections were carried out, numerous witnesses were interviewed and camera recordings were included. The proposals state that the collected evidence is sufficient to charge 4 members of Parliament and the mayoral candidate with a crime under Art. 325, para. 2, supra para. 1 of the Criminal Code - committing indecent acts, grossly violating public order and expressing clear disrespect for society - hooliganism, which is distinguished by extreme audacity and for I. Chorbov, by exceptional cynicism.

The actions of N. Dimitrov, I. Chorbov and Y. Todorov were also conducted by resistance against Ministry of Interior employees, and for Y. Todorov, hooliganism is a continuing crime consisting of two separate acts (Art. 26, para. 1 of the Criminal Code).

I. Chorbov's immunity has also been requested for the unlawful destruction of police uniforms (a crime under Article 274a, paragraph 3 of the Criminal Code), as well as for arson of property of significant value (the building of the Representation of the European Commission in Bulgaria) as the fire posed a danger to the lives of people nearby and there was a risk that the fire would spread to other real estate, inventory and goods (a crime under Article 330, paragraph 2, item 1 and item 2, in conjunction with paragraph 1 of the Criminal Code).

The request for lifting the immunity of S. Krumov for a crime under Art. 330, para. 2, item 1 and item 2, paragraph 1 of the Criminal Code - arson, states that sufficient evidence has been collected for him throwing lit pyrotechnic articles and bottles with flammable liquid at the building of the Representation of the European Commission in Bulgaria.

The Acting Prosecutor General indicates in his requests to the National Assembly that there are prerequisites for submitting a request to the Sofia City Court to take a preventive measure "detention in custody" against I. Chorbov and S. Krumov.

In view of the provision of Art. 70, para. 1 of the Constitution of the Republic of Bulgaria, for bringing a member of Parliament to justice as an accused for a crime of a general nature committed by him, permission from the National Assembly is required. For candidates for mayor, according to Art. 160, para. 1 of the Electoral Code, permission is granted by the Central Election Commission.
