Sofia City Prosecutor's Office brought to justice and detained B.S., presidential candidate, for up to 72 hours

Today, November 3, 2021, an investigator from the Investigation Department at Sofia City Prosecutor's Office (SCPO) presented a decree for bringing a charge against B.S., a presidential candidate, in the presence of an ex officio appointed defence counsel.

After the leading investigator assigned to the bodies of the Ministry of Interior, B.S. was identified and forcibly brought to the building of the Specialized Department of the SCPO.

B.S. was brought to criminal liability for crimes committed by him under Art. 325, para. 2 in conjunction with para. 1, Art. 20, para 2, and para 1 and under art. 131, para 1, item 12 in conjunction with art. 130, para. 2 of the Penal Code.

In the course of the investigation of the pre-trial proceedings initiated in the Sofia City Prosecutor’s Office additional evidence was collected which the supervising prosecutor assessed as sufficient under Art. 219, para. 1 of the Criminal Procedure Code for bringing to justice and a second indictment for B.S. for a crime committed by him under Art. 131, para. 1, item 12 in conjunction with Art. 130, para. 2 of the Penal Code (causing minor bodily injury on hooligan motives).

According to the supervising prosecutor the evidence gathered indicates not only the existence of a reasonable suspicion for crimes committed by  B.S., but also for a justified real danger of the same one to hide, since after taking action to summon him, he was not found at the addresses known in the case.

The crimes committed are characterized by extreme audacity and disrespect for the democratic foundations of the state.

Their intensity and the data for the previous conviction of the accused indicate a high degree of public danger, which according to the supervising prosecutor requires the detention of B.S. for up to 72 hours.

In this regard, a proposal was prepared by the Prosecutor General of the Republic of Bulgaria to the Cеntral Electoral Commission for granting permission to detain B.S. according to Art. 64, para 2 of Criminal Procedure Code.

Following a decision of the Cеntral Electoral Commission, the accused was detained for up to 72 hours in order to submit a request to the Sofia City Court to impose a measure of remand in custody.

The accused pleaded not guilty and availed himself of the right not to give explanations.
