The Prosecutor General submitted a request to the Central Election Commission to waive the immunity of a presidential candidate

The Prosecutor General submitted a motivated request to the Central Election Commission (CEC) for permission to prosecute B.S., nominated by an initiative committee as an independent presidential candidate in the elections scheduled for November 14, 2021. The request was made after a proposal by a prosecutor from the Sofia City Prosecutor's Office.

The pre-trial proceedings were initiated at 5th Police Department - Sofia under the supervision of the Sofia Regional Prosecutor's Office and were subsequently sent to the Sofia City Prosecutor’s Office. The investigation was assigned to an investigator at the Sofia City Prosecutor’s Office Investigation Department.

The pre-trial proceedings were instituted for the fact that on 30.10.2021 B.S. in complicity as a perpetrator with other unidentified persons, has committed obscene acts, grossly violating public order and expressing obvious disrespect for society, which are characterized by extreme audacity - a crime under Art.325, para.2 of the Penal Code.

The evidence gathered are sufficient within the meaning of Art.219, para 1 of the Criminal Procedure Code for bringing to criminal responsibility and charges against B.S. It has been established that on October 30, 2021, at about 5.30 pm, he and a group of persons entered the office of a foundation on boulevard „Knyaz Al. Dondukov“  in Sofia and started shouting, tearing down furniture and spraying the walls.

In the course of the investigation, witnesses were interrogated, identified, and other investigative actions were carried out.

As a candidate for president B.S.  is a "person with immunity" and in view of the provision of Art.160, para.1 of the Election Code, in order to bring him to justice for a crime of a general nature committed by him, a permit of the Central Election Commission is required.
