The Prosecutor General of Republic Bulgaria Ivan Geshev sent an official letter to the Secretariat General of the Council of Europe and to the European committee for crime problems in order to inform them about difficulties in the cooperation with the Serbian authorities regarding the extradition of the Bulgarian citizen Ts.V.

“The lack of judgmental decision of the competent authorities of the requested state – Republic of Serbia according the concrete case, in relation with criminal proceedings against the Bulgarian citizen Ts.V., questions the effective implementation of the European Convention with regard to the obligations of the requested country to take the decision in reasonable time limits”, reads the letter of the Prosecutor General. It also stressed out that it has been 5 years and 6 months since the first request to the Serbian authorities and 4 years and 8 months since the second request for extradition of Ts.V.
A copy of the letter of Ivan Geshev was send also to the President of the European Parliament – David Sassoli and to the President of the European commission – Ursula von der Leyen with a view to the future assessment of the preparedness of Republic Serbia as a candidate for EU membership and the implementation of the principle of the rule of law in the judicial procedures. According to the European arrest warrants the Prosecutor General mentioned that the deadline for extradition of wanted criminal citizens is 90 days /3 months/.
The Prosecutor General of Republic Bulgaria Ivan Geshev sent also a letter to the Supreme Court in Belgrade, Serbia in order to declare that the request of the Bulgarian state for extradition of Ts.V. since 2014 is still remaining.
“We find it difficult to understand the reason for the delay of your final decision by almost 5 years and 6 months since the sending of our initial request and more than 4 years and 8 months since our second request for extradition of the Bulgarian citizen Ts.V. I would like to inform you that this is an unprecedented delay in our practice as requesting country since the legal mechanism of the European Convention for extradition has been implemented”, said the Prosecutor General in his letter.
“We would like to note that the criminal proceeding against Ts.V. for the embezzlement of money from KTB is remarkable for the Bulgarian legal history, which affected the economic and financial stability of the country”, said Ivan Geshev to the Supreme court in Belgrade, Serbia.
